These are the Terms & Conditions established by The Quaker Oats Company, its parents, contractors
and agents (collectively referred to in this document as “Company”) regarding how you can participate in
the Cap’n’s Cove event taking place April 15th, 2023 at the Margaritaville Resort in Palm Springs,
California (the “Event”).
To ensure a spot on the SMOOTH SAILING LIST at the Event or attend the Event you will be required to show a valid 21+ ID to enter.
You must agree to these Terms & Conditions and agree to, complete, and sign Cap’n Crunch’s 60th Birthday Event Activation Waiver & Release Of Liability & Publicity Rights prior to participation in the Event. You have the option to complete your waiver prior to arrival in order to unlock access to the SMOOTH SAILING LIST and receive priority access to the event.
When signing up for the SMOOTH SAILING LIST, you can only sign-up for yourself and you must sign Cap’n Crunch’s 60th Birthday Event Activation Waiver & Release Of Liability & Publicity Rights prior to participation in the event, otherwise you will be required to go through the walk-up line.
If joining the Event as a walk-up, you must sign the Cap’n Crunch’s 60th Birthday Event Activation Waiver & Release Of Liability & Publicity Rights at check-in prior to participation in the Event, in addition to showing your ID.
If checking into the Smooth Sailing line, you will need to show your confirmation email listing your full name and a valid, government issued photo ID proving you are 21 years or older. During check-in, someone will verify that you’ve signed and completed the waiver.
Completed waivers do not guarantee entry into Cap'n's Cove, but will expedite the check-in process via the SMOOTH SAILING check-in lane. The event is first come first served and space is limited. Guests are encouraged to arrive prior to 11:00am.
Company reserves the right to change or cancel the Event (at any time) including, but not limited to, canceling or changing event times, for any reason at its sole discretion, and in such event, Company will not be responsible for payment of any expenses, costs or losses incurred as a result of any change or cancellation.
Company reserves the right to refuse entry or ask you to leave the Event space: (1) if you violate these Terms & Conditions or any instruction of Company’s agents or contractors at the Event; (2) if your physical or mental condition or behavior would be considered, in the sole opinion of Company, a risk to other persons at the Event; or (3) if, in the sole opinion of Company, you are unfit to participate in the Event or your behavior
Neither rebooking, exchange nor any reimbursement will be issued due to a cancellation, change, disruption, weather conditions or any inability to attend, complete or fully enjoy the Event.
Company has a “zero tolerance” policy toward any illegal activity or behavior. Company will report incidents of illegal activity or behavior to the appropriate law enforcement authorities.
Company reserves the right to confiscate, destroy and/or turn over to authorities any items it deems in its sole discretion to be detrimental to the safety or comfort of any person.
Some Events may contain visual images with light patterns, rolling images, or flashing lights, which may trigger epileptic seizures in a small percentage of individuals. Such conditions may also trigger previously undetected epileptic symptoms or seizures in individuals without prior epileptic symptoms or a history of epilepsy. If you have an epileptic condition we encourage you to consult your doctor prior to attending any Event.
You are responsible for getting to and leaving the Event responsibly.
You are responsible for maintaining your ticket, wristband and/or voucher in a safe location and Company shall not be obligated to replace any ticket, wristband and/or voucher after initial issuance.
Other than qualified service animals, you may not bring any live animals. You will be solely responsible for any and all damage and/or loss caused by a service animal.
You may not bring any weapons, knives, firearms, contraband, ammunition, explosives, incendiary devices, or other dangerous items into the Event.
You may not bring alcoholic beverages to the Event, alcoholic beverages will be available for purchase.
You may not engage in smoking of any kind including, but not limited to, tobacco, marijuana, cigarettes, cigars, pipes, vaporizers, and electronic cigarettes.
You may not bring any illegal controlled substances to the Event.
You agree that at all times during the Event, with or without notice, the Company has the right to search your personal effects for any prohibited items, to ensure compliance with these restrictions. If you refuse any such search or screening, or you are traveling with prohibited items and/or attempting to enter the Event with any such items, you may be denied entry and no rebooking, exchange nor any reimbursement will be issued. You will be solely responsible for any and all damage and/or loss caused by your violation of these Terms & Conditions.
You agree to follow the directions of the hotel crew and agents and contractors of Company.
You agree to abide by all applicable federal, state, and local rules and policies, whether related to COVID-19 or otherwise.
You may not solicit anyone at the Event for any commercial, professional, illegal, or illicit purposes.
You agree not to engage in any lewd, lascivious, indecent, obscene, offensive, or outrageous behavior while participating in the Event.
You will ensure that your clothing and accessories are respectful to fellow guests. Specifically, items worn during the Event should not contain any message that may be considered offensive or contain nudity, profanity, sexual innuendo/suggestions. In addition, clothing/accessories should not promote negative ethnic or racial commentary, or hatred or violence in any form.
Prohibited items include but are not limited to the following:
Animals (excluding certified service animals)
Airhorns, Noise Making devices, or other aerosol containers
Backpacks, luggage, and other large bags
Bags Larger than 12x6x12 will not be allowed
Balls, Balloons, frisbees or other possible projectile objects
Bottles (glass, metal, plastic) coolers, hydration packs
Cameras with detachable lenses, video cameras or equipment
Chairs, lounges, seat cushions
Costumes or non-medical masks
Drones or any remote-control aircraft
Firearms, knives, or weapons of any kind
Fireworks, lasers, confetti, or glitter
Flags, signs, obscene, indecent, or inappropriate clothing
Food and Beverage of any kind
Alignment sticks, selfie sticks or mono/tripods
Illegal drugs, Hazardous materials, chemicals
Laptops (Tablets are allowed)
Scooters, skateboards, skates, roller shoes, hoverboards, etc.
Speakers, radios, or TVs
Strollers, wagons, or buggy-like objects
Weapons (i.e., knives, pepper spray, stun guns, tasers, any concealed weapons, firearms, etc.)
Unapproved pamphlets, handouts, advertisements, etc.
Other items as determined by facility management
Company reserves the right to handle each occurrence on a case-by-case basis. Depending on the item, the guest may either be asked to remove the item from the facility or dispose of the item or may be ejected from the facility. All bags, jackets, and guests are subject to search upon entering the Event. Lockers and other onsite storage are not available for any prohibited items.
Your attendance at or participation in the Event indicates your agreement to and that you will fully comply with these Terms & Conditions. These Terms & Conditions are governed by the laws of the State of California without regard to its choice of law provisions.
